The following are the Terms and Conditions (the “Terms of Use”) which govern your access and use of the website and our online support group platform (the “Platform”). The Platform may be provided or be accessible via multiple websites or applications whether owned and/or operated by us or by third parties, including, without limitation, the website www.buttonsproject.org.sg and its related apps.
By accessing or using the website or the Platform, you are agreeing to these Terms of Use. You should read the Terms of Use carefully before starting to access or use the website or the Platform. If you do not agree to be bound by any clause in these Terms of Use, you must not access or use the website and the Platform.
When the terms “we”, “us”, “our” or similar are used in these Terms of Use, they refer to Buttons Project Singapore Ltd (the “Company”).
In the event that any changes are made, the revised Terms of Use shall be posted on our website immediately. Please check the latest information posted to inform yourself of any changes. Continued access or use of the website and the Platform is deemed to be your acceptance of any changes to the Terms of Use.
1. About Us
Buttons Project Singapore Ltd. (“Buttons Project Singapore ”) is a registered company limited by guarantee in Singapore. Our Platform provides a safe space for women who have been through abortion and are negatively affected by it to find encouragement and support.
2. Online Support Group
Our online support group is meant only for women who have been through abortion in their own personal lives and have been negatively affected by their abortion experiences. It allows women to share their experiences and emotions openly while others may offer encouragement.
While we hope that the support group will be beneficial to you, you understand, agree and acknowledge that services in an online environment may not be appropriate to meet everyone’s needs, may not be appropriate for every situation, and/or may not be a complete substitute for in-person services.
You agree, accept and acknowledge that subject to the below, it is your responsibility to determine whether or not the online support group will be appropriate for your specific circumstances.
You acknowledge and accept that the Platform is not designed for or appropriate for circumstances where you are considering self-harm or harming another person, or your own safety or the safety of another person is otherwise at risk.
3. Not A Substitute for Professional Counselling
Buttons Project Singapore is run by a team of volunteers. They may not have degrees in professional counselling. Hence, the online support group and the Post-abortion Healing programme are not intended to be substitutes for professional counselling.
4. Referral to Professional Counselling
Buttons Project Singapore may refer you to professional counselling upon your request or if considered appropriate by the mentors of the support group. The professional counsellors referred to you may not be in the same country of residence as you.
5. Medical Advice
The content on our website and the Platform or any content on other sites that is linked to our website and the Platform is for informational purposes and is not a substitute for professional medical advice. This Platform is not intended for any information regarding which drugs or medical treatment may be appropriate for you and you should disregard any such advice if delivered through the support group.
The nature of the online Platform is such that we are not in a position to undertake a physical examination or have full review of your medical history. As such, you should speak to a doctor with regards to your medical condition or treatment.
Do not delay seeking advice or dialling emergency services because of something that you have read on our support group. Do not disregard, avoid, or delay in obtaining in-person care from your doctor or other qualified professional because of information or advice you received through the support group.
6. Emergencies
Please note that Buttons Project Singapore does not provide any emergency or crisis counselling. If you are feeling suicidal and you would like immediate assistance, please call the police on 999 or Samaritans of Singapore (SOS) on 1800 214 4444. If you feel that you may be at immediate risk of harming yourself, call 995 or approach the Accident and Emergency (A&E) department of your nearest hospital. If you are in a country outside of Singapore, please call your country’s emergency hotline for immediate assistance.
7. Anonymity
You may share sensitive information about your abortion experiences and your personal life on our Platform. If you would like to remain anonymous, we recommend that you use a pseudonym in your display name on the online support group.Any information or experiences you share may carry the risk of revealing your identity to others. Please read our Privacy Policy carefully before you sign up for an account.
8. Mentors
The mentors in our online support group consists of women who have been through abortion as well as others who may not have been through abortion. All communication with mentors and other women in the support group is to be kept strictly within the online platform. As such, we will not ask for your personal contact details apart from the sign- up form.
9. User Guidelines
Please refer to our user guidelines on the online support group platform. We will determine the appropriate course of action for any breach of user guidelines we deem appropriate, including withdrawing your right to use our online support group; removing any post or material you have uploaded; taking legal action against you; or disclosing such information to law enforcement authorities as we reasonably consider to be necessary.
10. Registration
You will be added to our online support group after you have signed up for an account and have filled in the ‘Sign Up’ form. Our online support group is facilitated by a third-party community platform, circle.so. Any information and personal data that you use during your account sign up process is accessible to circle.so. Please visit the circle.so website to find out more about their privacy policy. Buttons Project Singapore will not be liable for any data breach by circle.so.
11. Non-faith Based Community Support
This is a non-faith-based support community. Any woman who is hurting after abortion, regardless of her religion, may join us in this community. We do not impose any of our religious views on anyone here, and please do likewise. You may, however, share about how your religion has helped you in your journey if it is an integral part of your life.
12. Post- Abortion Healing Programme
i. Our post-abortion healing programme is run via the online support group platform.
ii. This is a faith-based programme. The Bible and prayer are foundations of the healing programme. The activities in the support group and the post-abortion healing program may involve Bible reading and prayer, which you may opt out of if you do not feel comfortable.
iii. This is a paid programme. Payment must be made as specified by Buttons Project Singapore before the start of the programme and the programme fees may be subject to foreign exchange rates. In the event that you do not make payment for the services provided by Buttons Project Singapore as and when such payment may fall due, no services may be rendered to you.
iv. There may be video conferencing sessions with participants who join in this programme before, during or after the programme. The participant consents to video, audio and text recording of the session. The participant agrees that if the participant prefers that a session not be recorded for any reason, the participant must give prior notice of this to Buttons Project Singapore.
Subject to the above in this clause, Buttons Project Singapore will not disclose any information that may identify the participant without the participant’s prior express consent, except when required by law.
13. Video Conferencing App
Buttons Project Singapore may use any available video conferencing app for the purposes of online support group as it deems fit, having regard to the needs of the user, security of the app, ease of use, accessibility, or any other relevant considerations.
You agree that you will not carry out any video- or audio-recording during the session, without the prior express consent of Buttons Project Singapore.
14. Informed Consent
You agree, acknowledge and accept that all input given, statements made and suggestions provided by us are only for your consideration.
You agree that you are solely responsible for any decisions that you make (including acting upon them) as a result of any discussion with any volunteers and members in the support group.
15. Legal Requirements
Buttons Project Singapore is bound by the laws of Singapore, and other countries as may be applicable, which may require us to disclose certain information. In such circumstances, we may disclose information to the extent necessary to seek legal advice or fulfil any applicable legal obligations.
16. Limits of Confidentiality for Online Support Group
As the Platform utilises the internet for the transmission of information, we will take all reasonable measures within our control to protect your confidentiality. However, we shall not be held responsible or liable for any data breach that is not within our control and cannot be prevented by such reasonable measures.
17. Proprietary Rights
The entire contents of our website and the Platform are protected by copyright, database rights and other intellectual property rights which are owned by us. Contents of our website and the Platform may not be copied, displayed, downloaded, distributed or republished other than for non-commercial individual reference with all copyright or other proprietary notices retained, and thereafter may not be recopied, reproduced or otherwise redistributed. Nothing contained herein shall be construed as conferring by implication, estoppels or otherwise any licence or right under any patent or trademark of Buttons Project Singapore.
18. Written Communication and Notices
When using the website and the Platform, you accept that communication with us will be mainly in electronic format. We may contact you by email or provide you with information by posting notices on the Platform or our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
19. Disclaimer of Warranty and Limitation of Liability
You hereby release us and agree to hold us harmless from any and all causes of action and claims of any nature resulting from the website and the Platform, including (without limitation) any act, omission, opinion, response, advice, suggestion, information and/or service of any member and volunteer at Buttons Project Singapore, and/or any other content or information accessible through the website and the Platform.
You understand, agree and acknowledge that the website and the Platform is provided “as is” without any express or implied warranties of any kind, including but not limited to merchantability, non-infringement, security, fitness for a particular purpose or accuracy. The use of the website and the Platform is at your own risk to the fullest extent of the law, we expressly disclaim all warranties of any kind, whether express or implied.
You agree that the maximum aggregate liability owed by us, whether in contract, tort (including negligence) or otherwise, shall not exceed the fee for the programme, and we will not be liable to you or any third party for any indirect, incidental, exemplary, special, punitive or consequential damages.
If the applicable law does not allow the limitation of liability as set forth above, the limitation will be deemed modified solely to the extent necessary to comply with applicable law.
For the avoidance of any doubt, this clause shall survive the termination or expiration of these Terms of Use.
11. Your Account, Representations, Conduct and Commitments
You hereby confirm that you are legally able to consent to receive Services or have the consent of a parent or guardian, and that you are legally able to enter into a contract.
You hereby confirm and agree that all the information that you provided in or through the website or the Platform, and the information that you will provide in or through the website or the Platform in the future, is accurate, true, current and complete. Furthermore, you agree that during the term of these Terms of Use you will make sure to maintain and update this information so that it will continue to be accurate, true, current and complete.
You agree, confirm and acknowledge that you are responsible for maintaining the confidentiality of your password and any other security information related to your account (collectively “Account Access”). We advise you to change your password frequently and to take extra care in safeguarding your password.
You agree to notify us immediately of any unauthorised use of your Account Access or any other concern for breach of your account security.
You agree, confirm and acknowledge that we will not be liable for any loss or damage incurred as a result of someone else using your account, either with or without your consent and/or knowledge.
You agree, confirm and acknowledge that you are solely and fully liable and responsible for all activities performed using your Account Access. You further acknowledge and agree that we will hold you liable and responsible for any damage or loss incurred as a result of the use of your Account Access by any person whether authorised by you or not, and you agree to indemnify us for any such damage or loss.
You agree and confirm that your use of the website or the Platform, including any services provided by Buttons Project Singapore, is for your own personal use only and that you are not using the Platform or the Services for or behalf of any other person or organisation.
You agree and commit not to interfere with or disrupt, or attempt to interfere with or disrupt, any of our systems, services, servers, networks or infrastructure, or any of the Platform’s systems, services, servers, networks or infrastructure, including without limitation obtaining unauthorised access to the aforementioned.
You agree and commit not to make any use of the website or the Platform for the posting, sending or delivering of either of the following: (a) unsolicited email and/or advertisement or promotion of goods and services; (b) malicious software or code; (c) unlawful, harassing, privacy invading, abusive, threatening, vulgar, obscene, racist or potentially harmful content; (d) any content that infringes a third party right including intellectual property rights; (e) any content that may cause damage to a third party; (f) any content which may constitute, cause or encourage a criminal action or violate any applicable law.
You agree and commit not to violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code in relation to your use of the website and the Platform.
If you receive any file from us, whether through the Platform or not, you agree to check and scan this file for any virus or malicious software prior to opening or using this file.
You will indemnify us, defend us, and hold the members and volunteers at Buttons Project Singapore. harmless from and against any and all claims, damages, losses, causes of action, demands, costs, liabilities or expenses (including, but not limited to, legal fees and disbursements on a full indemnity basis) arising out of or relating to any of the following: (a) your access or use of the Platform; (b) any actions made with your account or Account Access whether by you or by someone else; (c) your breach of any of the provisions of these Terms of Use; (d) non-payment for any of the services (including Services) which were provided through the Platform; (e) your violation of any third party right, including, without limitation, any intellectual property right, publicity, confidentiality, property or privacy right. This clause shall survive the expiration or termination of these Terms of Use.
You confirm and agree to use only credit cards or other payment means (collectively “Payment Methods”) which you are duly and fully authorised to use, and that all payment-related information that you provided and will provide in the future, to or through the Platform, is accurate, true, current and complete, and will continue to be accurate, true, current and complete.
You agree to pay all fees and charges associated with your Account according to the fees schedule, the terms and the rates as published on the website or the Platform. By providing us with your Payment Methods you authorise us to bill and charge you through that Payment Methods and you agree to maintain valid Payment Methods information in your Account information.
If you have any concerns about a bill or a payment, please contact us immediately by sending an email to hello@buttonsproject.org.sg. We will evaluate your issue on a case-by-case basis and, at our discretion, take steps to resolve any issue, including but not limited to issuing partial or full refunds if applicable.
12. Modifications, Termination, Interruption and Disruptions to the Platform
You understand, agree and acknowledge that we may modify, suspend, disrupt or discontinue the Platform, any part of the Platform or the use of the Platform, whether to all clients or to you specifically, at any time with or without notice to you. You agree and acknowledge that we will not be liable for any of the aforementioned actions or for any losses or damages that are caused by any of the aforementioned actions.
The Platform depends on various factors such as software, hardware and tools, either our own or those owned and/or operated by our contractors and suppliers. While we make commercially reasonable efforts to ensure the Platform’s reliability and accessibility, you understand and agree that no platform can be reliable and accessible at all times and so we cannot guarantee that access to the Platform will be uninterrupted or that it will be accessible, consistent, timely or error-free at all times.
13. Notices
We may provide notices or other communications to you regarding these Terms of Use or any aspect of the Platform, by either email to your email address that we have on record, or by posting it online. The date of receipt shall be deemed the date on which such notice is given. Notices sent to us must be delivered by email to hello@buttonsproject.org.sg.
14. Important Notes About the Terms of Use
These Terms of Use and our relationship with you shall both be interpreted solely in accordance with the laws of Singapore. You hereby agree to submit any dispute arising out of the Terms of Use to the exclusive jurisdiction of the courts of Singapore.
These Terms of Use constitute the entire agreement between you and us. You confirm that you have not relied upon any promises or representations by us except as set forth in these Terms of Use.
We may change these Terms of Use by posting modifications on the website or the Platform. Unless otherwise specified by us, all modifications shall be effective upon posting. Therefore, you are encouraged to check the terms of these Terms of Use frequently. The last update date of these Terms of Use is posted at the bottom of the Terms of Use. By using the website or the Platform after the changes become effective, you agree to be bound by such changes to the Terms of Use. If you do not agree to the changes, you must terminate access to the Platform and participation in its services.
We may freely transfer or assign these Terms of Use or any of its obligations hereunder.
The paragraph headings in these Terms of Use are solely for the sake of convenience and will not be applied in the interpretation of these Terms of Use.
If any provision of these Terms of Use is held by a court of competent jurisdiction to be illegal, invalid, unenforceable, or otherwise contrary to law, the remaining provisions of these Terms of Use will remain in full force and effect.
To clear any doubt, all clauses regarding limitations of liabilities and indemnification shall survive the termination or expiration of these Terms of Use.
